BY RESERVING, YOU AGREE TO COMPLY WITH THE FOLLOWING CONDITIONS:

Since 2012, Home in Montreal / Hôtel Val-David (9273-5885 Québec Inc.) has been offering fully furnished short- and long-term apartments to travelers and business professionals from around the world. In Québec, short-term rentals (stays of less than 32 nights) are regulated by the government and the CITQ (Corporation de l’Industrie Touristique du Québec). All of our apartments are fully licensed and compliant with local tax requirements.

The following terms and conditions apply to all reservations made between Home in Montreal / Hôtel Val-David (“we”, “our”) and our guests (“you”, “the guest(s)”) for the rental of any furnished property, either short-term or long-term (“the property”).

1. Number of occupant : 
All additional guests not listed in the original reservation must be declared. Additional charges may apply per guest per night. Unless otherwise agreed upon in writing, only the number of guests listed on your reservation at the time of booking will be permitted to stay at the property.
Should you wish to invite visitors, prior written approval is required. If the number of occupants exceeds the number of guests confirmed in your booking without our prior consent, we reserve the right to ask you and your group to vacate the premises immediately, without refund.

2. Smoke-Free Environment : Smoking is strictly prohibited indoors in all of our properties. Outdoor smoking (on balconies or in gardens) is permitted; however, cigarette butts must be properly disposed of in a bin or ashtray. Any breach of our non-smoking policy—including lingering smoke odor—will incur an automatic penalty of $500 CAD.

3. Pets : 
We are happy to welcome pets in our apartments for a fee of $75 CAD per pet, per stay. Please notify us at the time of booking if you plan to bring a pet.
The following rules apply:
Hygiene:

3.1. Pets are not allowed in the bedrooms.
3.2. Pets must never be allowed on the sofas, and cats must not scratch any furniture. We kindly ask that you bring your own protective covers if necessary.
3.3. Guests are responsible for cleaning up after their pets.
Safety:

3.4. Dogs must not bark excessively or cause disturbances.
3.5. Dogs must be kept on a leash at all times when outside the apartment.

4. Check-In / Check-Out : 
Standard check-in begins from 3:00 PM, and check-out is required by 11:00 AM. Should you wish to arrive earlier or depart later, we would be happy to accommodate your request subject to availability and applicable fees. Please contact us in advance to confirm. Kindly note that written approval and payment of the relevant fee (if applicable) are required for early check-in or late check-out. A late check-out fee of $20 CAD per 15-minute increment will apply if departure is delayed without prior arrangement.

5. Stay Extensions : 
We understand that plans can change. While we cannot guarantee availability, we are happy to check options for extending your stay. Please contact us as early as possible to explore availability. Note that all stay extensions must be paid in full in advance to be confirmed.

6. Keys & Security : 
Your safety is our priority. Building entrances may be monitored by security cameras, and doors should be kept locked at all times.
You will receive full access instructions via our digital guestbook, sent by email no later than 7 days prior to your arrival. If you have not received it within that timeframe, please contact us.
Depending on the property, access may be via a secure key box with a physical key, or a unique digital code. Please note that lost keys are subject to a replacement fee of at least $100 CAD plus tax.

7. Elevators and Accessibility for Guests with Reduced Mobility : 
None of our properties have elevators, and some have stairs. Guests with reduced mobility are encouraged to contact us before booking to ensure their chosen property meets their needs. The best option would be the "Le Tierra" apartment in Montreal.

8. Minimum Age and Responsibility of the Booking Guest : 
You, the person making the reservation, must be at least 18 years old and have the legal authority to enter into a binding agreement. All information provided by you on this website must be true and complete. Guests under 18 must be accompanied by an adult at all times during their stay. You are responsible for informing all members of your group about the terms and conditions of the booking, including applicable rules and restrictions.

9. Noise Policy and Guest Behavior : 
Neighborhood quiet hours, as mandated by law, are from 10:00 PM to 8:00 AM. Loud music, parties, or gatherings exceeding the maximum number of guests allowed are strictly prohibited. Guests must avoid excessive noise, disturbances, or any behavior that disrupts the neighbors.
You are responsible for ensuring respectful and appropriate behavior from everyone in your group.
Home in Montreal / Hôtel Val-David reserves the right to ask you to leave the property without a refund if you or anyone in your group fails to respect our staff or neighbors, violates these terms, damages the property, or engages in any criminal activity.
Our properties are intended solely for private/residential use. Parties, social functions, commercial activities, or events (such as photoshoots, exhibitions, commercial offices, weddings, large receptions, or cocktail parties) are not permitted without prior written approval.
Should law enforcement be called to intervene, a penalty of $500 CAD will be charged,
and the rental agreement will be immediately terminated, with guests required to vacate the property—regardless of the time of day or night.

10. Property Care and Cleaning : 
Please treat the property, furnishings, accessories, appliances, and equipment with care and leave them in the same clean and orderly condition as when you arrived. Furniture must not be moved. Each property is cleaned, prepared, and inspected before your arrival to ensure a welcoming experience. A professional cleaning service is included in your reservation fee. Additional mid-stay cleanings or linen changes can be arranged at an extra cost.
At checkout, guests must leave the property in a reasonably tidy state—disposing of trash and recyclables, putting away items, restoring furniture to its original placement, and washing dishes, countertops, and tables. If the property is left in an unreasonable condition, extra cleaning fees will apply at a rate of $80 CAD per hour plus tax.

11. Complaints and Issues : 
We make every effort to ensure that the property is clean and in good condition before your arrival. In the unlikely event that you are disappointed with the property or encounter any issues or damages, please notify us immediately. We will do our best to resolve any problems as quickly as possible.
Claims received after your departure cannot be accepted, as it will be difficult for us to conduct a thorough investigation.
If you leave the property before the end of your reservation without our authorization, you will not be eligible for any refunds or discounts, unless we have violated the terms and conditions of this contract.

12. Cancellation Policy : 
All cancellation requests must be sent via email. We do not accept cancellations or modifications by phone. Since we incur costs from the moment we confirm your booking and may be unable to resell your stay, the following cancellation terms apply:
The cancellation policy for your reservation depends on the terms outlined by the booking platform you used. If you booked directly on our website (www.homeinmontreal.com), the following policy applies:
- Full refund for cancellations made at least 30 days before check-in.
- No refund for cancellations made less than 30 days before check-in.
If your arrival is delayed beyond the check-in date or you leave earlier than your scheduled departure, no refunds or modifications can be made under any circumstances. We strongly recommend purchasing appropriate travel cancellation insurance.

13. Changes and Cancellations by Us / Relocation : 
In exceptional circumstances or force majeure situations (e.g., flooding or fires), whether before your check-in or during your stay, we will contact you via email and do our best to offer you an alternative property from our portfolio.
- If the alternative property is lower in price, you will receive a credit.
- If the price is higher, we may waive the additional cost at our discretion, or you may be asked to pay the difference.
- If you decline the alternative offer, we will provide a refund as follows:
- 100% refund if your check-in has not yet occurred.
- A partial refund based on the unused nights if your stay has already begun.
We regret that we cannot reimburse any additional expenses, costs, or losses resulting from changes or cancellations on our part. Please note that cancellations by us are extremely rare and unlikely.

14. Children Policy : 
We welcome families with children and babies. Children under 2 years old stay for free when sharing a room with an adult. A portable baby bed can be provided free of charge upon request, subject to availability. As parents, you are responsible for your children's respectful behavior (including any visiting children) and for any damage they may cause, whether accidental or intentional.

15. What's Included ? : 
**Provided:** All properties are fully furnished to high standards and include :
- High-speed unlimited WiFi
- TV and air conditioning
- Hairdryer and iron
- Linens and towels
- Fully equipped kitchen with appliances (microwave, coffee maker, toaster, kettle)
- Cutlery, dishes, glasses, and kitchen utensils
- Washer and dryer (except in Le René Lévesque, Le St-Laurent, and Le Ste-Cath apartments, which have laundry rooms in the building)
- Dishwasher (except in Le Ste-Cath, Le St-Denis, Le Boston, and Le Montréal apartments)
- A starter kit of toilet paper, detergents, shower gel, shampoo, and hand soap
If anything is missing, please contact us right away so we can quickly resolve the issue!
**NOT provided:** Personal items (toothpaste, toothbrush, face cloths), phone service, food, or replacement gas for BBQ tanks.
Please note that we cannot be held responsible for internet network issues or compatibility problems between your laptop and our internet modem.

16. Liability & Insurance : 
Neither Home in Montreal / Hôtel Val-David, nor the property owner is responsible for any direct or indirect damages resulting from negligent use by guests, including damages, insurance claims, or losses due to fire, theft, or misconduct.
One property (Le Tierra) has a fireplace that guests are **NOT** permitted to use at any time. The property, furniture, and equipment are insured against fire, water leaks, burglary, and window breakage.
Your personal belongings, luggage, valuables, and personal injuries are **NOT** covered by the property insurance. We strongly recommend comprehensive travel insurance for yourself and all members of your party, covering luggage, cash, jewelry, valuables, and personal/civil liability.
You acknowledge that the property owner, Home in Montreal, and its team members will **not be responsible or liable for and will not compensate for**:
• Any loss or delay due to circumstances beyond our reasonable control, including acts of God, war, riots, explosions, civil disturbances, terrorist activity, natural disasters, fires, accidents, severe weather, strikes, or government regulations. In such "force majeure" cases, we may terminate the contract and, at our discretion, offer a pro-rated refund for unused nights.
• Any noise or inconvenience caused by renovation or construction work near the accommodation.
• Any breakdown of mechanical equipment such as pumps, boilers, heating/cooling systems, or failure of utilities (water shortages, power outages, TV or internet service interruptions).
• Any personal injury, death, or loss unless caused by proven negligence of the property owner, Home in Montreal, or our employees. You are responsible for proving negligence if making a claim.

17. Forgotten Items : 
Please ensure you have all your belongings when departing, as we accept no responsibility for personal items left behind. If our team finds forgotten items, we're happy to return them to you for a travel fee of CAD 60 plus postage costs. We reserve the right to dispose of unclaimed items after 30 days.

18. Right of Entry/Access : 
While respecting your reasonable privacy, we reserve the right to access all properties at any time if necessary for repairs, important maintenance, inspections, or emergencies. We'll do our best to minimize any disruption to your stay.

19. Our Website/Copyright : 
Rates, descriptions, and photos on our website may change at any time and are for information only.
While we make every effort to ensure website photos and descriptions are accurate, you must accept that minor differences may occur. We describe properties and their locations to the best of our abilities and in good faith. We accept no responsibility or refund claims for alleged misrepresentation.
Without notice, we reserve the right to make property changes (furniture, fixtures, facilities) deemed necessary or for continuous improvement.
We reserve the right to update these terms and conditions at any time if necessary.
All content on the Home in Montreal / Hôtel Val-David website (photos, videos, and descriptive text) is the exclusive property of Home in Montreal / Hôtel Val-David and is protected by copyright. No website content may be used or sold for profit without our prior authorization.

20. Personal Data Protection : 
We use SSL (Secure Sockets Layer) protocol, a security protocol used by browsers and servers to transmit sensitive information. (You can verify you're on SSL by checking the URL: the http at the beginning should change to https.)
To process your booking and ensure smooth travel arrangements, we must use the information you provide (name, address, etc.). We take full responsibility for ensuring appropriate security measures protect your information, and we will not share information with anyone not responsible for your travel arrangements.

21. Law : 
All contractual obligations arising from these terms and conditions are governed by Quebec and Canadian law. Any disputes regarding your stay will be handled by Quebec or Canadian courts.
